These terms set out how we work with clients and what each side is responsible for. They apply alongside — never instead of — the signed contract for your specific project.
Effective date: 16 August 2026
1. Introduction
These Terms of Agreement govern the relationship between QD Creative ("we," "us," "our") and any client ("you," "the client") engaging our construction, renovation, interior design, landscaping, swimming pool construction, electrical and solar, project management, and architecture and design services in Zimbabwe and South Africa.
2. Scope of Services
Services are defined per individual project agreement/contract signed between QD Creative and the client. General inquiries, quotes, and consultations do not constitute a binding service agreement until a formal contract is signed by both parties.
3. Quotations and Pricing
All quotations are estimates based on information and site conditions available at the time of assessment. Final pricing may be adjusted following detailed site surveys, material cost changes, or scope changes requested by the client. Any changes will be communicated and agreed upon in writing before proceeding.
4. Payment Terms
Payment schedules (deposits, milestone payments, final payment) are set out in the individual project contract. Work may be paused if scheduled payments are not received within the agreed timeframe.
5. Project Timelines
Estimated timelines are provided in good faith based on standard conditions. Delays caused by weather, permit approvals, material availability, or client-requested changes are outside our control and may extend the agreed schedule. We will communicate any material delays promptly.
6. Client Responsibilities
Clients are responsible for providing accurate site information, timely decisions on design/material selections, and any required legal permissions or permits for their property, unless otherwise agreed in the contract.
7. Warranties
Workmanship warranties are specified per project and service type in the individual contract. Warranties do not cover damage from misuse, third-party alterations, or normal wear and tear.
8. Liability
QD Creative carries out work to applicable local building and safety standards in Zimbabwe and South Africa. Liability for damages is limited to the terms specified in the signed project contract.
9. Cancellation
Cancellation terms, including any forfeiture of deposits for work already scheduled or materials already procured, are outlined in the individual project contract.
10. Governing Law
These terms are governed by the laws of the jurisdiction in which the project is undertaken (Zimbabwe or South Africa, as applicable).
11. Changes to These Terms
We may update these Terms of Agreement from time to time. Updates will be posted on this page with a revised effective date.
